The National Broadcasting Commission (Amendment) Bill, 2023 (HB 1270) proposes a major change to how satellite and cable television services are priced in Nigeria. Sponsored by Hon. Moses Oluwatoyin Fayinka, the Bill seeks to mandate satellite and cable TV providers to offer a “Pay-As-You-Watch” (PAYW) subscription model to Nigerian consumers.
The proposed legislation responds to concerns about the traditional fixed-bundle subscription model, under which subscribers pay for packages containing numerous channels regardless of how many they actually watch. The Bill aims to give consumers greater choice and flexibility by allowing them to pay for the specific content, channels or viewing periods they use.
What the Bill Seeks to Achieve
Under HB 1270, satellite and cable TV providers would be required to move away from mandatory fixed-term bundles and offer more flexible, usage-based subscription options. The proposal is intended to improve affordability, strengthen consumer choice, promote competition and encourage Pay-TV providers to develop more responsive pricing and content offerings.
The Bill would also expand the role of the National Broadcasting Commission (NBC) by giving it responsibility for overseeing and enforcing fair and flexible subscription models. This is significant because the existing NBC Act does not specifically regulate Pay-TV subscription payment structures.
Key Issues and Challenges
While the proposed PAYW model could strengthen consumer protection, the analysis identifies several challenges. The Bill does not clearly define what “Pay-As-You-Watch” means or specify whether billing would be based on individual channels, viewing time, specific content or events. This lack of clarity could lead to inconsistent implementation and legal disputes.
There are also questions about the technical and commercial feasibility of implementing a pure PAYW model, as well as its potential impact on existing contracts, licensing arrangements, smaller providers and investment in the broadcasting sector. The analysis further recommends a transition period and clear regulatory guidelines to give service providers time to adapt.
The analysis concludes that HB 1270 is a significant attempt to promote fairness, transparency and consumer protection in Nigeria’s Pay-TV sector. However, clearer definitions, detailed implementation guidelines and meaningful stakeholder engagement would be necessary to ensure that the proposed reform is effective and enforceable.
